Acceptable Use Policy
This Acceptable Use Policy (the “Policy”) outlines activities that are not permitted when using the digital customer loyalty program services and any related services (collectively, the “Service”) provided by Critical Path MEP, Inc. (“Critical Path MEP”). It also applies to the website located at criticalpathmep.com (the “Site”). This Policy complements and is incorporated into Critical Path MEP’s Subscription Agreement (available at https://terms.criticalpathmep.com/subscription-agreement) and the Site’s Terms of Use (available at https://terms.criticalpathmep.com/terms-of-use). If there is any conflict between this Policy and the Subscription Agreement or Terms of Use, the provisions of the Subscription Agreement or Terms of Use will control unless this Policy explicitly states otherwise.
If you breach this Policy, Critical Path MEP may suspend or terminate your ability to use the Service or access the Site. This right applies even when a violation occurs unintentionally or without your knowledge if Critical Path MEP determines that suspension or termination is necessary to comply with applicable laws or to safeguard the rights, security, privacy, safety, or property of Critical Path MEP, its customers, or other parties.
Critical Path MEP may update or revise this Policy at any time by publishing a new version on the Site. Continued use of the Service or access to the Site after such changes means that you accept and agree to the most current version of this Policy.
Intellectual Property
You may not use the Service or Site in any way that infringes, dilutes, misappropriates, or otherwise violates the intellectual property or proprietary rights of others. This includes, but is not limited to, rights related to copyrights, patents, trademarks, and trade secrets.
Harmful Content
You may not use the Service or Site to transmit, store, display, distribute, or otherwise make available any content or technology designed to harm or disrupt systems or data. This includes viruses, Trojan horses, bots, worms, scripting exploits, time bombs, or any other malicious or harmful code intended to damage, intercept, or improperly access systems or information.
No Framing or Scraping
You may not frame or mirror the Site without Critical Path MEP’s express prior written consent. You may not use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine,” or in any way gather any messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other content from the Service or Site or reproduce or circumvent the navigational structure or presentation of the Service or Site without Critical Path MEP’s express prior written consent. Notwithstanding the foregoing, Critical Path MEP grants to the operators of public search engines the permission to use spiders to copy material from the Site for the sole purpose of, and solely to the extent necessary for, creating publicly available searchable indices of such material, but not caches or archives of such material. Critical Path MEP reserves the right to revoke these exceptions either generally or in specific cases.
Email and Unsolicited Messages
You may not use the Service or Site to send unsolicited emails or messages, including bulk communications such as spam, or messages that are excessive, abusive, or intended to harass others. You must also respect requests from recipients who have indicated that they no longer wish to receive messages from you.
In addition, you may not alter or hide message headers, impersonate another sender, or misrepresent the origin of messages. This includes activities such as spoofing, phishing, or other deceptive communication practices unless the sender has explicitly authorized such actions.
System Security
You may not use the Service or Site to violate the security or integrity of any network, computer or communications system, software application or computing device (each, a “System”), including without limitation by attempting to: (a) probe, scan or test the vulnerability of a System or breach or circumvent security or authentication measures without authorization; (b) make network connections to, or otherwise access, a System without authorization; (c) monitor data or traffic on a System without authorization; (d) tamper, reverse-engineer, hack, interfere with, disrupt or disable a System, including without limitation by means of overloading, “flooding,” “mailbombing,” “crashing,” or denial of service attacks; (e) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; (f) use another party’s account name or persona without authorization; or (g) take any action in order to obtain a Service to which you are not entitled.
Privacy
You may not use the Service or Site to infringe on the privacy or confidentiality of others. This includes transmitting, storing, displaying, distributing, or otherwise making available another person’s private or confidential information—such as account details or personal data associated with their Service or Site account—without proper authorization.
Compliance with Laws
In addition to the restrictions listed above, you may not use the Service or Site for any unlawful purpose or in violation of applicable laws or regulations. This includes, but is not limited to, laws related to data protection, privacy, consumer protection, and export controls.
No High-Risk Use
The Service may not be used in environments where failure or malfunction could reasonably result in death, serious bodily injury, or significant physical or environmental damage. For example, the Service must not be used in connection with aircraft operations, mass transportation systems, nuclear facilities, chemical facilities, or other high-risk environments.
Responsibility for End Users
You are responsible for any violations of this Policy committed by individuals who access or use the Service or Site with your permission, including those using your account. Assisting or enabling another person to engage in activities that would violate this Policy if performed by you also constitutes a violation.
This Policy applies to all individuals who access or use the Service or Site. Each prohibition described here also applies to actions that a user directly or indirectly authorizes, facilitates, promotes, encourages, or permits, even if the user did not personally perform the prohibited act.
Monitoring and Enforcement
Critical Path MEP reserves the right, but does not have an obligation, to investigate any suspected misuse of the Service or Site or any potential violation of this Policy. At its sole discretion, Critical Path MEP may edit, refuse to publish, or remove any content submitted to or displayed on the Service or Site that it believes violates this Policy.
Critical Path MEP may also report activities that it reasonably believes violate laws or regulations to law enforcement authorities, regulatory bodies, or other appropriate third parties. Such reports may include the disclosure of relevant customer information when necessary. In addition, Critical Path MEP may cooperate with law enforcement or regulatory agencies by providing network or system information to support investigations or legal proceedings related to alleged violations.
Reporting Violations
If you become aware of any violation of this Policy, you must immediately notify Critical Path MEP by email at and provide Critical Path MEP with assistance, as requested, to stop or remedy the violation.
